Terms of Use

These Terms and Conditions (“Terms”) govern the provision of services by Clerked Ltd (“Clerked”, “we”, “us”, “our”) and your use of the Clerked platform, website, and related services (together, the “Platform”). By registering for, accessing, or using Clerked, you agree to be bound by these Terms.

1. About Clerked

Clerked (“we”, “us”, “our”) is a UK-based software platform designed to help legal professionals identify and contact barristers by providing visibility of availability, court attendance, and professional information. Clerked is not a law firm, legal adviser, barristers’ chambers, or agent for any legal professional.

2. Eligibility

To register for and use Clerked, you must:

  • Be at least 18 years old
  • Be a Legal Professional, Barrister, or authorised Clerk as defined in these Terms
  • Register using accurate and complete information

“Legal Professional” means any individual employed by, or who holds a directorship or ownership interest in, a law firm or legal organisation that engages barristers in the course of its practice. This includes solicitors, trainees, legal executives, paralegals, in-house counsel, and firm directors or owners.

Role-specific requirements:

  • Barristers must confirm at registration that they are current, practising members regulated by the Bar Standards Board (BSB). Clerked may request evidence and suspend or terminate access if unconfirmed.
  • Legal Professionals must confirm they are employed by, or are directors/owners of, a law firm or legal organisation that instructs barristers.
  • Chambers registrations must be made by, or on behalf of, a designated Primary Clerk authorised to act on the Chambers’ behalf.

We reserve the right to suspend or terminate accounts providing false, misleading, or unauthorised information.

3. User Roles

Clerked supports the following user types:

  • Legal Professionals
  • Barristers (Chambers-affiliated or Solo)
  • Clerks (Primary or Standard)
  • Chambers (non-user organisational entity)

Each role has access only to features relevant to its function.

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your login credentials.

  • Notify us immediately of any unauthorised access
  • We may suspend access if misuse or security risk is suspected
  • Clerked is not liable for loss arising from compromised credentials where reasonable security measures were in place

5. Use of the Platform

You agree to use Clerked:

  • Only for lawful, professional purposes
  • In accordance with these Terms and all applicable laws
  • Without attempting to access data you are not authorised to view

You must not:

  • Scrape, harvest, or extract data outside normal platform use
  • Circumvent access controls or security measures
  • Misrepresent your identity or professional status
  • Upload malicious code or interfere with platform operation
  • Use barrister availability or profile data for purposes other than identification and instruction through the platform

6. Availability & ClerkedLive

Clerked provides visibility of barrister availability based on:

  • Manual check-ins (ClerkedLive)
  • Calendar availability data (where authorised)

Availability is indicative only. Clerked does not guarantee accuracy, acceptance of instructions, or stability of availability. Final instruction, fees, and engagement remain between legal professionals, barristers, clerks, and chambers.

7. Calendar Synchronisation (Barristers)

Barristers may optionally connect their Microsoft Outlook calendar:

  • Grant Clerked permission to access limited calendar availability data
  • Confirm authority to grant such access
  • Withdraw consent at any time via account settings

On withdrawal, availability data will be removed within 24 hours. Clerked is not responsible for errors or third-party calendar inaccuracies. Upon account termination or cancellation, any calendar authorisation is revoked.

8. Email Clerk Functionality

The “Email Clerk” feature allows sending enquiries via Clerked backend (Brevo provider). Copies are sent to the legal professional’s email. Brevo retains logs per its retention policy. Clerked does not access or use these logs except for delivery confirmation and technical troubleshooting.

  • Clerked is not responsible for delivery, content, or outcomes of messages

9. Subscriptions & Payments

9.1 Paid Accounts: Barristers and Chambers pay fees. Legal Professionals access free. Payments are processed via Stripe, billed monthly unless stated, and non-refundable except where required by law.

9.2 Seat Allocation (Chambers): Charges start when a Seat is allocated. De-allocated Seats mid-cycle are not refunded; charges cease at the next renewal date.

9.3 Free Trials: Payment details required. Trials convert to paid unless cancelled. Personal data of non-converted trials deleted within 30 days per Privacy Policy.

10. Suspension & Termination

Clerked may suspend or terminate access:

  • For breach of these Terms
  • For non-payment
  • Where required by law
  • To protect platform integrity

Users may request cancellation at any time by contacting support@clerked.co.uk. Following termination or cancellation, personal data will be retained and deleted in accordance with our Privacy Policy. Users may request an export of their data prior to deletion.

11. Intellectual Property

All intellectual property in the Clerked platform, including software, designs, branding, and content (excluding user-provided content) remains the property of Clerked or its licensors. Users are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purposes.

12. Disclaimers

Clerked is provided on an “as is” and “as available” basis. We do not warrant that the platform will be uninterrupted or error-free, that data will always be accurate or complete, or that the service will meet all professional or commercial needs.

13. Limitation of Liability

To the maximum extent permitted by law, Clerked is not liable for indirect, consequential, or economic loss, loss of profits, reputation, opportunity, or loss arising from third-party services or data.

Total liability is limited to fees paid in the preceding 12 months. Nothing limits liability for death, personal injury, fraud, or any liability that cannot be excluded by law.

14. Indemnity

Users agree to indemnify Clerked against claims arising from:

  • Misuse of the platform
  • Breach of these Terms
  • Misrepresentation of professional status or eligibility
  • Unauthorised use of third-party data or systems

15. Privacy & Data Protection

Use of Clerked is subject to our Privacy Policy, which forms part of these Terms. The Privacy Policy sets out how we collect, process, and retain personal data including in connection with the Email Clerk feature and Brevo email logs.

16. Changes to These Terms

Clerked may update these Terms from time to time. Material changes will be communicated via the website or platform. Continued use constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
