Terms of Use

Clerked (“we”, “us”, “our”) is a UK-based software platform designed to help legal professionals identify and contact barristers by providing visibility of availability, court attendance, and professional information. Clerked is not a law firm, legal adviser, barristers’ chambers, or agent for any legal professional.

To register for and use Clerked, you must:

1. Be at least 18 years old
2. Be a Legal Professional, Barrister, or authorised Clerk as defined in these Terms
3. Register using accurate and complete information

For the purposes of these Terms, the following definition applies:

“Legal Professional” means any individual who is employed by, or who holds a directorship or ownership interest in, a law firm or legal organisation that engages barristers in the course of its practice. This includes, but is not limited to, solicitors, trainees, legal executives, paralegals, in-house counsel, and firm directors or owners.

In addition, the following role-specific requirements apply:

2.1 Barristers must confirm at the point of registration that they are a current, practising member regulated by the Bar Standards Board (BSB). Clerked may request evidence of BSB membership and may suspend or terminate access where this cannot be confirmed.

2.2 Legal Professionals must confirm at the point of registration that they are employed by, or are a director or owner of, a law firm or legal organisation that instructs barristers. By registering as a Legal Professional, you are confirming this status. Clerked may request evidence and may suspend or terminate access where this cannot be confirmed.

2.3 Chambers registrations must be made by, or on behalf of, a designated Primary Clerk who is duly authorised to act on the Chambers’ behalf and to accept these Terms.

We reserve the right to suspend or terminate accounts that provide false, misleading, or unauthorised information.

Clerked supports the following user types:

• Legal Professionals
• Barristers (Chambers-affiliated or Solo)
• Clerks (Primary or Standard)
• Chambers (non-user organisational entity)

Each role has access only to the features relevant to its function.

You are responsible for maintaining the confidentiality of your login credentials.

• You must notify us immediately of any unauthorised access
• We may suspend access where we reasonably suspect misuse or security risk
• Clerked is not liable for loss arising from compromised credentials where reasonable security measures were in place

You agree to use Clerked:

• Only for lawful, professional purposes
• In accordance with these Terms and all applicable laws
• Without attempting to access data you are not authorised to view

You must not:

• Scrape, harvest, or extract data from the platform for any purpose outside normal platform use
• Circumvent access controls or security measures
• Misrepresent your identity or professional status, including regulatory standing
• Upload malicious code or interfere with platform operation
• Use barrister availability or profile data for any purpose other than the genuine identification and instruction of legal professionals through the platform

Clerked provides visibility of barrister availability based on:

• Manual check-ins (ClerkedLive)
• Calendar availability data (where authorised)

Availability is indicative only. Clerked does not guarantee:

• Accuracy of diary data
• That a barrister will accept an instruction
• That availability will not change

Final instruction, fees, and engagement remain strictly between legal professionals, barristers, clerks, and chambers.

Barristers may optionally connect their Microsoft Outlook calendar. By doing so, you:

• Grant Clerked permission to access limited calendar availability data
• Confirm you have authority to grant such access
• May withdraw consent at any time via your account settings

On withdrawal, availability data will be removed from the platform within 24 hours. Clerked does not assume responsibility for errors, omissions, or third-party calendar data inaccuracies.

On termination or cancellation of your account, any connected calendar authorisation will be automatically revoked and no calendar availability data retained beyond the point of processing, in accordance with our Privacy Policy.

The “Email Clerk” feature allows legal professionals to send an enquiry directly to a clerk via the Clerked platform. When this feature is used:

• The enquiry is sent from the Clerked platform backend on the legal professional’s behalf, via Brevo, Clerked’s transactional email provider
• A copy of the message notification is sent to the legal professional’s registered email address
• Brevo retains email logs in accordance with its own data retention policy. Clerked does not access or use these logs for any purpose other than delivery confirmation and technical troubleshooting. For further information see www.brevo.com

Contact information used to route messages (such as clerk email addresses) is sourced from professional profile data held on the platform and is not retained or further processed by Clerked beyond the point of transmission.

Clerked is not responsible for:

• Delivery of messages
• Content of correspondence
• Outcomes of communications

9.1 Paid Accounts

Barristers and Chambers are required to pay subscription fees. Legal Professionals access the platform free of charge. Payments:

• Are processed via Stripe
• Are billed monthly unless otherwise stated
• Are non-refundable except where required by law

9.2 Seat Allocation (Chambers)

Chambers may purchase Seats for Barristers. The following terms apply:

• Charges begin when a Seat is allocated, regardless of whether the Barrister completes onboarding
• Seats that are de-allocated mid-billing cycle are not eligible for pro-rata refunds
• Charges will cease at the next billing renewal date following de-allocation

9.3 Free Trials

Where Clerked offers a free trial period, the following terms apply:

• Payment details are required at the point of registration for the free trial
• At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the expiry of the free trial
• You are responsible for cancelling before the end of the trial period if you do not wish to be charged
• If a free trial account is not converted, personal data will be securely purged within 30 days of trial expiry in accordance with our Privacy Policy

We may suspend or terminate access:

• For breach of these Terms
• For non-payment
• Where required by law
• To protect platform integrity

You may request cancellation at any time by contacting support@clerked.co.uk.

Following termination or cancellation, Clerked will retain and delete your personal data in accordance with our Privacy Policy. You may request an export of your data prior to deletion by contacting support@clerked.co.uk.

All intellectual property in the Clerked platform, including software, designs, branding, and content (excluding user-provided content) remains the property of Clerked or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purposes.

Clerked is provided on an “as is” and “as available” basis. We do not warrant that the platform will be uninterrupted or error-free, that data will always be accurate or complete, or that the service will meet all professional or commercial needs.

To the maximum extent permitted by law, Clerked is not liable for indirect, consequential, or economic loss, loss of profits, reputation, or opportunity, or loss arising from third-party services or data. Our total liability is limited to fees paid in the preceding 12 months.

Nothing in these Terms limits liability for death or personal injury, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.

You agree to indemnify Clerked against claims arising from:

• Your misuse of the platform
• Breach of these Terms
• Misrepresentation of your professional status or eligibility
• Unauthorised use of third-party data or systems

Use of Clerked is subject to our Privacy Policy, which forms part of these Terms. The Privacy Policy sets out how we collect, process, and retain personal data including in connection with the Email Clerk feature and Brevo email logs.

We may update these Terms from time to time. Material changes will be communicated via the website or platform. Continued use constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
